Data Protection and Processing Policy
Information on the Protection of Personal Data
We are considered the data controller under the scope of the Personal Data Protection Law No. 6698 ("PDPL") as European Service Anonymous Company. We would like to inform you about how we process and share your personal data.
1. How We Collect Information
We may collect your personal data through transactions you make with us, interactions with our websites, from our physical locations, your mobile device, or, where legally permissible, from third parties.
2. Information Collected About You
The personal data we collect from you (including but not limited to your name, age, gender, contact information, place of residence, previous rental information, and credit card details) is proportionate to the processing purposes outlined in Section 3 below.
3. How We Use Your Personal Data
3.1 The legal reasons for processing your personal data under Article 5 of the PDPL are as follows:
a) The existence of your explicit consent for the processing of your personal data,
b) Being clearly stipulated in the laws,
c) Being mandatory for the protection of life or bodily integrity of a person who cannot express his consent due to actual impossibility or whose consent is not legally valid,
d) Being necessary to process personal data for the performance or establishment of a contract,
e) Being mandatory for the fulfillment of a legal obligation,
f) Personal data being made public by the data subject,
g) Being mandatory for the establishment, exercise or protection of a right,
h) Being mandatory for the legitimate interests of data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.
3.2 Subject to the conditions specified in the PDPL, we may use the information we collect for the following purposes (with your explicit consent and/or where legally permitted):
- Managing car rentals and commercial relationships, contacting you regarding car rentals, and assisting you with related matters.
- Performing customer service activities and conducting phone conversations related to customer satisfaction.
- Verifying the driving and credit information (including personal data) you provide through credit agencies, licensing authorities, fraud prevention agencies/databases, and other sources for the purpose of preventing fraud.
- Contacting you regarding incomplete membership forms or reservations on the internet.
- Providing information to relevant insurance databases about accidents you are involved in. In this context, processing personal data may be necessary in cases where it is necessary to create, enforce, or defend legal claims or respond to legal requests.
- Contacting you via email, text message, phone, or other means through commercial electronic communications using your contact information (including customer satisfaction surveys, discounts, special offers and/or marketing promotions, invitations, advertisements, celebrations, and survey applications).
- Improving our products and services for you.
- Compiling statistics and analyses about the use of our websites, products, and services by our customers.
- Protecting our rights and assets.
- Providing more customized and better services to you.
- Planning and executing corporate sustainability activities.
- Planning and executing marketing processes for goods or services.
- Planning and executing processes necessary to ensure customer loyalty and increase it.
- Providing your personal data to state institutions monitoring traffic regulations to assist in the implementation of traffic regulations during your rental period.
- Providing your personal data to the relevant tax office or authority, persons conducting debt collection, credit institutions, and other relevant institutions.
- Processing/storing your personal data in cases where it is considered that you may pose a risk for future rentals in the event of an incident arising from your relationship with us.
We may combine the information you provide with information about your transactions with us, such as the rental location and type of vehicle, from third parties that help us fulfill your requests, maintain our data, and optimize our services.
4. How Personal Information Can Be Shared and Sharing Purposes
Subject to your explicit consent and/or legally permitted circumstances, your personal data may be shared with the following parties in line with the purposes stated in Section 3 above:
- We may transfer your personal data to Avp Car Rental entities, our business partners (including our agencies in Turkey), suppliers, and other service providers (including information technology service providers and other consultants) in Turkey or abroad. Avp Car Rental may use your personal data for the purposes specified in Section 3 and may transfer your personal data to third-party service providers (within or outside Turkey).
- We may transfer your information to our business partners, service providers, public institutions, and/or individuals legally authorized to act on your behalf to protect your rights and those of third parties, provide administrative or technical support, and perform your transactions outside of Turkey when it is legally required and/or permitted by law.
- Your personal data may be transferred to another company in the event of a partial or complete transfer, change of ownership, or restructuring of Avp Car Rental and its assets.
- We would like to point out that if the location of the recipient of your personal data is considered a country with an insufficient level of protection by law, we will ensure the required protection levels by law and/or obtain your explicit consent for the transfer if legally necessary.
5. Your Rights Under PDPL
In accordance with the PDPL, you have the right to:
a) Learn whether your personal data is processed,
b) Request information if your personal data has been processed,
c) Learn the purpose of processing and whether this data is used for its purpose,
d) Know the third parties in Turkey or abroad to whom your personal data has been transferred,
e) Request the correction of your incomplete or incorrect personal data,
f) Request the deletion or destruction of your personal data in accordance with the conditions stipulated in Article 7 of the PDPL,
g) Request that the third parties to whom your personal data has been transferred be notified of the processes under (e) and (f) above,
h) Object to the result of an analysis made exclusively through automated systems,
i) Demand compensation for any damages you may incur due to unlawful processing.
Our company will evaluate and conclude your request in accordance with the PDPL. To correctly respond to your request, please clearly specify which personal data your request pertains to. Requests under the PDPL will be concluded, free of charge, within thirty days at the latest (provided that there is no cost)."
